Legal Question in Construction Law in New York
if owner decides to sell building in the middle of construction, do we have to return any funds? What are we entitled to when this happens ?

You have lien rights. Selling a property under construction may be a breach of contract. Talk to a lien lawyer. See my website, kevinjconnollylaw.com. You usually return nothing.
