Legal Question in Construction Law in New York

Owner's Right to cancel

I signed a contract for a mason to install a brick sidewalk and stoop. I gave no deposit and the NYS 3 day cancelation period has passed. The contract does not state a Start date. However, the contractor has failed to show up and perform the work twice.

What are my rights to cancel the contract?

Re: Owner's Right to cancel

It depends on the language of your contract. For instance some contracts require written notice and an opportunity to cure a default before terminating the contract. The prudent thing to do is to contact a lawyer to review the contract and handle the termination process, if necessary, properly. Otherwise you could find yourself in default for improper termination.
