Legal Question in Construction Law in New York
Removal of Mechanics Lien
A mechanics lien was placed on our home during constrution. It has now been almost two years and we would like to get back the monies we paied into the courts to get our mortgage. We were told that we need to file a court order to release this money. So we need to know how to write one for this situation.

Re: Removal of Mechanics Lien
A proceeding must be commenced in court to either vacate the lien or resolve the dispute which caused the lien to be placed to begin with. Sending a letter will not do. More information is necessary to determine the type of proceeding that you must file. You should arrange for a consultation with an attorney to review your circumstances. Our office handles such proceedings.
