Legal Question in Construction Law in New York
roofing contract
my husband and i have a roofing co.
we were subcontracted to do (labor only) application of a slate roof.
The work was schedualed for one date and then the contractor that sub-contracted our company called one week ahead of schedual to see if we could start that week(one week sooner) with some re-shedualing on my part with other work comittments, i made it possible.
My husband and his crew of 3 men went on day 1 to start job. Constructing skafolding in preperation to start this slate application. There first order was to apply copper metal drip edge aroung the perimeter of the roof.
After opening the box of drip edge ever piece was damaged. Our company had to pull of the job that day until the drip edge matter was resolved. 2 days later our co. went back to job site now there was a problem with the material that was applied over the plywood in preperation for slate. At this the job was put on hold indefinetly.
My husband and his crew broke down skafoldinf and pulled of job.
I (wife/office manager)re-schedualed our company work.
approx. 2-3 weeks contractor calls and says''o.k. problem corrected.''
I say''Great, but we can't get back for about 1-1/2 months not exceptable to him and gets another subcontractor. he's sueing

Re: roofing contract
Its hard to answer because there are many relevant details. What are the details of the suit? That he had to hire another to finish the job? Whose responsibility was it to get the supplies? You need to speak with an attorney to understand the relevant details.
Please let me know if you need anything further.
