Who has the right to set terms of payment for services provided from a subcontractor to a contractor?

No one has any "right" to set terms. It is negotiated. If you can't come to a meeting of the minds, don't contract. If you already have contracted and the contract does not speak to the issue (incredibely badly written contract) then it is usually read against the party that provided the contract.
