time delay for contract work

our contract stated work would be completed in 4-5 weeks. Throughout the job, we communicated via email the importance of the deadline and the contractor assured us the job would be done in ''at most 5 weeks''. But the contractor did not even order the cabinets until 3 weeks into the job. In addition, no one showed up to work for the second and third weeks. The job is nowhere's near done after 7 weeks. At what point can we legally cancel the contract? Also, I'm not sure the contractor is actually licensed. Does this change things?

A lack of a valid contractor's license changes a lot. Before you do anything else, go online and check to see if in fact your contractor is licensed. It's available on the New York Department of State website under licensing.
