Legal Question in Construction Law in New York

Unpaid Invoices

Hi! I work for a transfer station, i.e. a yard that among other things, supplies materials to contractors. One contractor had picked up a large amount of materials from us on credit and has not paid. My questions is: should we pursue placing a mechanic's lien on his job or should we simply sue him for the unpaid invoices? What are the advantages to either or are they mutually exclusive/inclusive?

Any help is greatly appreciated! Thanks very much.

Re: Unpaid Invoices

You can do either. A mechanics lien is an expensive proposition and so is a lawsuit. The amount of money involved, among other things, makes a difference from a business point of view.
