wood floor installation problem

in april 2007 my contractor hired--name removed--flooring company to put in engineered hardwood floor in my apartment. the existing floor boards' edges were raised and it was clear that there was some sort of moisture problem. the contractor and the floor installer both said there was--name removed--moisture problem. fast forward to december 2007, my new floor is showing moisture problems; turns out that the installer didn't seal the concrete prior to installation and the moisture from the concrete is damaging the wood floor. i contacted the floor installer and he insists that it's not an installation problem. it's--name removed--building structural problem. in this case, whose responsibility is this? i believe it is the installer's responsibility to prepare the subfloor properly prior to installation. do i have--name removed--case if i have to take the legal avenue?

It seems to me that you should be naming everybody and their brother: Owner, installer, manufacturer, wholesaler, sales etc and let them fight it out. You shouldn't care where the chips fall as long as they are on a solvent defendant.

Go to a lawyer. I know of flooring in these latest NYC condo's going for upward of 100k. If so you have a case. Get to a lawyer and let him do what it is he does.
