Legal Question in Consumer Law in New York
Bought car with reversed odometer
Hello,
I bought a car via phone/e-mail from recommended person (I live in Europe, the car I bought from USA). Unfortunatelly despite the person confirmed (also in email) the odometer is 10 000 miles (so is on issued invoice I got from the person) - on the ''certificate of title for a vehicle'' from Department of Motor Vehicles the first digit is illegible (like sb corrected it with pen) and checked via AutoCheck service last confirmed odometer is 60 000.
My question is what is my chance to get refunded for the difference in a car I bought and the one I received ? Additionally what is the consequence for the person of fabricate Department of Motor Vehicles certificate (correcting the digit to hide real odometer facts) ?
Thanks in advance for you support
Best regards
Chris

Re: Bought car with reversed odometer
I would think that since there was a material misstatement concerning the odometer reading, you should be allowed to either return the vehicle or obtain a reduction in the price.
It is a criminal act for a person to fabricate an odometer reading.
Mike.
