Legal Question in Consumer Law in New York
Breach of Contract & Deceptive practice
My wife & I signed a contract at a used car dealer for a car that we realized was being advertised by the dealership at a cheaper price. They wrote BINDER on the contract and took a deposit. When they were confronted, they refused to sell us the car. They subsequently, sold the car, but kept advertising the car for another month. We are suing in Small Claims for the diff. between a similar car we purchased and the car they refused to sell us. Have there been any other cases like this, success rate for claimant and further remedies that may be sought, whether in another court or agency?

Re: Breach of Contract & Deceptive practice
It's a small claim. You have a good chance of winning if you get the attorney general to take it as a "bait and switch" or some other "phishing scheme.
Good Luck.
