Being Charge for Non-Return of Property

Can a private refuse company charge you for a garbage tote, even though you don't have it? We cancelled the service of a local company, and went with another company. The old company sent us a bill for their tote, which they took, full of trash. At least we assume it was them, as the tote, filled with trash was removed from the front of our house. The new company that we went with told us that they did not take the tote, when they dropped of our new tote with them. The old company keeps sending us bills for $189.00 and will not return our phone calls.

Send them a letter sent Return Receipt Requested and tell them that they picked up the tote, you do not owe them anything and that you do not intend to pay anything further. Then start sending their unopened bills back to them. Mark them SATISFIED or SENT IN ERROR on the front of the envelope.
