Legal Question in Consumer Law in New York
Consumer/Used Auto Sale
I purchased a vehicle (06 model) on 7/24/08 from a dealer and encountered a few problems. The first day I drove the car away, the gas was one notch above empty, the car made a grinding sound when I turned my wheel, and the check engine light was on. I couldn't take it back right away because I was half way to a wedding I had to attend and could not go back. I brought it back the next day and the dealer fixed the problem. I was also given a temp registration. A month passed and I realized my registration and title never came, the temp registration was about to expire. I called the dealer and was told that my vehicle needed a new inspection. I found out that the dealer was supposed to have to the car inspected before I drove it away. I got a new inspection on my own and the dealer sent me my registration within 5 days. Now, it's been 4 weeks and I have not received my title. The dealer also gave me a vehicle history report from VehicleCheck when I asked for a copy of the vehicle history; it came up clean. I did a Carfax check today and I discovered my car was in a collision repair shop. What Should I do?

Re: Consumer/Used Auto Sale
You may have a case against the dealer, depending on the severity of the prior damage and the extent to which it affects the vehicle's safety. Also, the dealer must transfer title to you. If not, then you have a claim for breach of warranty of title. Please contact my office directly if you would like to discuss further.
