Legal Question in Consumer Law in New York
Contract not fulfilled
I had a company come into my home to do waterproofing in my basement. After it was completed we had a flood and they came out and tore it up again. This was in Nov 07 and it is still torn up. Do we have legal recourse?

You would have to send a "time of the essence" letter and give them a reasonable date to complete the job. The letter must also state what will happen if the job is not complete - thrown off, hire another contractor to complete, sue for damages.
If the company fails to comply, you may commence an action for breach of warranty and damages.
