Legal Question in Consumer Law in New York

Dry Cleaner missing item

I gave my wedding dress along with my crown headpiece to my local dry cleaner to clean and preserve. You shouldn't open the box so that air doesnt get in to preserve the white of the dress. When I picked my dress up I asked the owner if the headpiece was in the box, and even called when I got home to ask again (I had a bad feeling) he assured me it was and even said ''It is what it is.'' I opened my box and my crown headpiece is not in the box. I called the dry cleaner and asked for the owner. I was told that they did not know when the owner will be in or when he would be able to call me back. When i asked for his name they told me Jazi (the name of the cleaners, and I know very well that is not his name). Do I have any legal course?

Re: Dry Cleaner missing item

Your recourse is to sue the dry cleaner in small claims court for the actual value of the crown headpiece plus the value of any emotional distress you have suffered as a result of their negligence (or theft). Be advised that small claims arbitrators/judges rarely award damages for emotional distress, but you should ask for it anyway.

Good luck!
