Legal Question in Consumer Law in New York

Hospital Error

Recently I was admitted to Northshore Long Island Jewish Hospital. The hospiatl called Empire Blue Cross and told them that I was admitted but later the hospital called back Empire Blue cross and told them that I was not admitted to the hospital. This information by the hospital is incorrect.

Now, I noticed that Empire Blue Cross is only paying 50% of each bill instead of 100%, because the hospital gave them incorrect information and because the hospital cancelled the preauthoritization.

I believe that the hospital should be responsible for its own damages and that I should not pay 50% of each bill because of the hospital fault.

What can I do to avod paying these bills ?

Re: Hospital Error

If you have evidence provided by the hospital that you were admitted, I would convey that to Empire Blue Cross as proof of your position. If not, you will need to have an attorney recover your file from the hospital to ascertain whether you were formally admitted.

Feel free to contact me with any further questions on this matter.
