Legal Question in Consumer Law in New York

Hotel policies

My husband reserved a room for two nights at a hotel in New York City. The hotel's website said that all rooms had cable tv. When he arrived at the hotel, he checked in and went to his room. After being in the room for five minutes, he realized that the television had only a couple of channels, none of which came in clearly. He went down to the front desk and said that he could not stay here if there was no cable tv, because he needed to watch a show that night for his work. The person at the desk said ok. My husband left, and that hotel charged our credit card for the two nights that my husband had reserved. They have refused to refund the money. Do we have a case to bring to small claims court? Do we have any other options? Thank you.

Re: Hotel policies

Dispute the charge with your credit card company. That will probably resolve it.

Other possible resolutions depend on NY law, which I do not know. New York does regulate the hotel/mnotel industry fairly closely, so you may want to find out on the web what agency regulates hotels and file a complaint with them.

If the hotel is a major chain, complain in writing to the highest level of management of the chain or its holding company. Copy the regulatory authority.

Re: Hotel policies

Your best bet is to notify your credit card company that you dispute the charge. They hadve the clout to work it out. To sue in small claims would'nt be worth the time or aggravation.
