Legal Question in Consumer Law in New York
What legal action can I take?
A company was given permission to electronically debit a checking account via signed contract on certain dates. This company proceeds to take money out of the account on two occassions on the wrong date once to hide a accounting error and make the consumer account for the clerical error. Later the company doesn't even bother to take out funds on the agreed upon date and the customer has to resolve the companies delinquent payment. What can I do? Do I have any legal recourse?

What's the dollar amount involved, one or one
thousand? I suspect more towards the former rather than the latter. If so, you may have legal recourse but as a practical matter it would'nt be very prudent to pursue it.

This is clearly a breach of contract
A termination letter based upon the breach is in
order
If you have suffered damages, a demand for reimbursement
of such is also in order
Find an alternate method of paying
