Legal Question in Consumer Law in New York
parking lot responsibility
I was at a local k-mart and my truck was damaged while I was in the store. A third party agent for the corporate says that I should have my truck fixed myself because they are not responsible. I have asked two auto shops what they believe damaged my truck and they both said a shopping cart. Who is responsible?

A case can be made that they are responsible. If the damage is less than the small claims limit, or the commercial claims limit, then file against them and let an arbitrator or judge decide the issues. If the damage is substantial enough, then you may want to get a lawyer to handle this for you.
