Legal Question in Consumer Law in New York

Problem with Architect

I hired an architect to make plans a driveway. My neighbor has a similar house and had this same architect make plans for their driveway. After the building department approved the plans the architect asked that I pay him with cash and I did.

When I consulted a contractor he realized that the plan was not properly drawn. I checked the dimensions on the plan and they did not match my structure. I then realized that the architect thinking that my property was the same as my neighbors submitted the same plan for approval. I now have a plan that is useless and an architect that is avoiding me.

What is my next step? Should I demand a refund? Thank you, CJC

Re: Problem with Architect

You should either demand a refund or you should ask that he redraw the plans.

You have an action against his malpractice insurance, but there are time limits with such a case.

Did you get a reciept for the cash you paid???

You should have an attorney. In fact an attorney's letter will likely bring you a quicker and better result. If you are interested in our help, you may contact me by following the links below.

Good luck.
