How do I know if my vehicle qualifies for a repurchase or replacement under the New York Lemon Law?

Requirements of the New York Lemon Law

There are several elements that you must establish in order to qualify for New York Lemon Law relief.

First and foremost, within the first 2 years or 18,000 miles from when you took delivery of the vehicle, you generally need to show that the vehicle was subject to repair either 4 times for the same defect, or was out of service for repair at least 30 days. The defects forming the basis of your case must "substantially impair the value of the vehicle" to you. Generally, that would mean that the functionality or safety of the vehicle is detrimentally impaired by its defects.

If you can demonstrate these elements, you likely have a case under the Lemon Law. However, even if you do not meet these requirements, there are other statutes, besides the Lemon Law, which may be applicable in your situation.
