Legal Question in Consumer Law in New York

slander? verbal abuse?

I ordered and paid for a poster from a website: posterworld dot com based in CA. Never arrived. I contacted Posterworld. Also told them their 2 phone #'s didn't work. I recieved a nasty, possibly slanderous reply. This was Greg, owner of Posterworld's (barely legible) reply:

your no producer except of hot air , i will fill it when i get to it in

the order i recieved it i am on april 16-17th. my numbers work just fine

its your brain thats broken ,so it takes me a couple weeks to fill

orders big deal loudmouth so shut your big mouth i dont waste time

holding the hands of fools like you answering their time wasting

complaints -should i hold up a patient persons order so i can waste

time answering your hyper whining ? stop bothering me, if you want a

refund say so half wit and you can pay twice as much somewhere else

Do small businesses like Posterworld have to adhere to the same rules as large corps? Example, if I went into the Gap and told the salesperson I couldn't find the jeans, they'd never say ''that's because you're a halfwit moron,'' they'd assist me. Why should Posterworld be allowed to abuse me when Gap can't? I did get a refund, finally but the money isn't my problem, it's the way I was spoken to.

No, small companies are rather varied in their work ethic, etc. You should file a complaint with the BBB on them...maybe after you get the poster or at least in a week or two.
