Can I sue my contractor for a leaking roof if we had no written contract? He has offered to fix the problem, but I want him to tear it down and redo it all at his cost?

Generally, you would have to give the contractor the opportunity to fix the problem. If he is unable to fix the problem after a reasonable period of time, you would be able to sue the contractor for breach of contract.
