Legal Question in Consumer Law in New York
Tuition Refund
I applied to a college and my friend prepaid the tuition for me with his credit card. But I notified the school that I would not attend it two weeks before the first semester. However the school is reluctant to give the money back. After two months of fruitless negotiations with the school I decide to go to a small claim court. I wonder who should be the claimant, me or my friend? or both of us?
Thanks.

Re: Tuition Refund
You would be the claimant. There is no privity of contract between your friend and the school. In other words, there was never any agreements between your friend and the school.
Mike.
