Legal Question in Consumer Law in New York

windows delivered with wrong deminsions

In person, I ordered 4 custom built windows, handing the clerk the contractor's written deminsions. After entering the deminsions, he asked me to sign below with a $300 deposit. At delivery, the two largest windows were 1 inch more in height than the contractor's deminsion sheet.

I called , a person told me ''you signed it, you own it''.

Now, the district manager, thru the clerk who entered wrong data, is offering me two new windows ''at their cost' of $180.00 plus another delivery charge of $58.00.

Original cost of the 2 windows were $520.00 plus $58 delivery charge.

Is clerk accountable?

Should I go to small claims court?
