Legal Question in Consumer Law in New York
In New York State can a 16 year old buy a car from a 17 year old with cash and have that be a legal binding sale? The seller stated in writing the vehicle is in mint condition, but after purchasing and having inspected it was discovered it had many problems. Because of this and because the buyer is only 16 and signed the purchase agreement for the car and titling the vehicle in his name so it is his can this be upheld or can he legally get his money back for this sale?
1 Answer from Attorneys
Under certain (most) conditions, a person below the age of 18 years can repudiate his contracts. You would do well to consult an attorney, because the law is not as simple as it could be. How you account for the beneficial use of the vehicle, what to do about damage to the vehicle, and other issues, call for legal advice.
