Apartment loan

Hi,

As a LOAN to a friend I wrote my personal check of $3,500.00 for an apartment.

There was no writing of our agreement, but I was told I was to be paid $3,500 over the course of 3 months.

I was given several checks, one bounced, one I was told to hold, one check for $200 was cashed successfully.

I do have several emails in which the tenant said they would pay me back.

Also - I have the approval form from the landlord so the tenant could live in the premises.

Can I collect successfully in the State of New York?

Sounds like a valid small claims court case to me. But can he pay?

I would think that since you have the check demonstrating the loan and various other documents demonstrating attempted payment, you would be able to demonstrate a cause of action.
