Legal Question in Credit and Debt Law in New York
Hi, On April 1, 2010, my cousin's wife died in a tragic car accident. My cousin is currently disabled. He is now getting letters and phone calls from DCM and West Asset Management debt collectors to pay the deceased's outstanding credit card balances. He is currently paying the joint credit card balances. Is he or the estate liable in New York for the balances due on the credit cards that were in her name only? Thank you, Keith

The estate-probably, him personally, probably not. I lack enough info to give a detailed answer. Speak with the atty handling the accident case (don't be surprised-there is often the ability to sue in an accident case where many no-legal professionals think there is not. But move FAST and get that atty engaged. We have statutes of limitations in NY far tighter than the 3 years people assume-2 years for wrongful death, a few months against a municipality, etc.)
