Audio Tape Recorded Agreements

I have a taped recorded agreement (nothing on paper) between myself and another person. This agreement was for the other person to pay back money that is owed me over a specific period of time. On 1 recording the party was aware they were being recorded on the other they were not. Can both or either of these recordings be used in Small Claims court as a binding agreement?
