Legal Question in Credit and Debt Law in New York

Capital One Credit Card Lawyer has sent me a letter stating that his client (Capital One)

has authorized them (the Lawyer) to start a lawsuit against me for past credit card debt.

What can i do to fight this, I was a victim of credit card fraud (Identity theft) back in 2008.

What option are availabe in my situation. I dont want to file for bankruptcy and I dont want to pay a debt that was never mine...

Please provide assistance and guidance.

I would send a copy of the police report to the lawyer with the explanation that you are a victim of identity theft.
