Legal Question in Credit and Debt Law in New York

car repo

last month i was told that my carpayment was late and made arrangements to overnighted my car payment it was recieved on the 8th on the 9th they issued a repossession order the check cleared on the 10th. placing me on track. on sunday the 13th my car was removed from my driveway by a tow truck. now im told that i am responsable for the fee for the tow company because they didnt recieve anything to stop this from happening from the bank. am i responsable for the charges.

There is a communication problem here. Obviously.

If the payment people (the bank) told you to overnight the payment then they are responsible for the repossession fees.

If the bank only told you to get it in as soon as possible, then you are unlucky.

In any event, the tow company did nothing wrong. The question is whether you owe them the money or the bank does.
