Legal Question in Credit and Debt Law in New York
CC a/c judgement from court
I had a Citibank c/c a/c from 1996-2002 & had a total balance of $8479. This went to collection for non payment & ended up being sold to some other co. for more money ($16045) for profit. currently a law firm is handling this a/c for them & has sent me a judgement from the the county of ny court. i have been in constant contact with all the parties involved trying to resolve this a/c. they didnt even advise me about the fact that this is in court. Is their anyway i can settle this a/c less than the original amount i owed ($8479)?? Also, is it lawful to sell my c/c account to other companies for profit without my consent?? please help. this is my last c/c acccount thats keeping me away from my dream of being debt free. thanks, a.f.

An Order to Show Cause can be filed to have the judgment vacated which would give you much better leverage in settling the matter, this area of law does happen to be one of our specialties, however, we would need some more information before making a complete and proper determination. Re: CC a/c judgment from court
Debt is bought and sold all the time and it is legal. Your amount goes up because of interest in your credit card agreement that you agreed to when you began using the card.
However, no judgmnet could have been taken against you unless and summons and complaint was served on you and filed and you defaulted. If you think that it has not happened this way, contact me immediately by e-mail with your telephone number for a free consultation.
Re: CC a/c judgement from court
Its possible to negotiate this debt downward or even vacate the judgment if you have meritorious grounds (and are willing to pay legal fees). Feel free to give my office a call to discuss this matter.
