Legal Question in Credit and Debt Law in New York

Charge an online monthly subscription without knowing

I must have signed up for some promotional account with AOL 2 years ago, that I thought would just cancel on its own after the month was over, instead, they activated the account and have been charging my credit card for $25 a month for the last 2 years and I haven't noticed until now. Since I never used AOL once during the last 2 years I called them up furiously, told them i want all my money back and said that i never used their services, but they say that I had the option to use those services and that there was some virus blocker installed on my computer from them and that was protecting my computer for the last 2 years, which i think is inaccurate, because I have never seen a prompt from AOL Virus protection, for anything, nor a request to update or anything, so I don't believe I have used any of their services at all, but they say the charges are valid. So I said I have never signed on or used anything related to AOL, they don't care, they are not going to refund me. Can I do anything about this and get my money back.

Re: Charge an online monthly subscription without knowing

I have heard similar stories. Since you are looking at approximately $600 in damages, I would commence action against AOL in small claims court. The cost for AOL to contact an attorney to defend may result in a settlement.

A small claims action must be commenced in the jurisdiction where AOL is located. Since I believe AOL has an office in Manhattan, I would suggest commencing a small claims action there.
