Legal Question in Credit and Debt Law in New York

Need clear definition of SOL for my verizon issue

Verizon Bill shows the last date I placed a call was Sept 5th 2001. However, the last payment that was made was May 2001. The last bill they sent me of October 2001 shows no activity except for verizon adding taxes and surcharges to the debt.

Does SOL apply and if so what applies in this case??

1. Does the last date of call placed the date of last activity? or 2. The last time a payment was made (which was May 2001). or 3. That last bill verizon sent in October 2001 with nothing but the surcharges and taxes they've added.

I believe it would be the last billing date under your agreement. In other words, if you placed your last call on Sept 5, 2001, and under your agreement the invoice for that call would be delivered on October 1, 2001, then the statute of limitations would start to run on October 1, 2001.

either way 6 yrs statute may have run...verizon is a phone carrier...they have all kinds of statutory protections, tariffs, etc. I am not sure that they don't have the right to collect...they have the right to sue you and YOU must interpose the defense of SOL or it will be waived...
