Legal Question in Credit and Debt Law in New York
clerical error
I receive child support via a court order. The non-custodial parent is incarcerated and has been unemployed since mid-November 2008. His former employer continued to pay his child support. I did not know who was paying his support while he was in prison and never asked. They have realized their error and want the money back. Are they entitled to it back?

They certainly would be entitled to return of the money from the non-custodial parent. Assuming that the employer paid the support through the Support Collection Unit, I think they would be hard pressed to be able to get the money from you.
