Legal Question in Credit and Debt Law in New York

Collection Agency Scam?

I have received a letter from AFNI collections regarding a Bell Atlantic bill from1998. I cannot even remember if the number cited was one I ever had! This debt is almost 10 years old! I went through a bankruptcy in 97 and since then my credit report is clean and I have a high score. I do not want anything to ruin it. I have heard of numerous people who have also heard from AFNI regarding ancient bills. They want me to pay half of the amount due. Any comments?

Re: Collection Agency Scam?

The statute of limitations for a contractual cause of action is 6 years. Therefore, you are not responsible for this debt.

Re: Collection Agency Scam?

Mike is right on as far as legal action against you is concerned. However, that doesn't mean it can't hurt you with the credit bureaus. In order to protect your credit score you should seek verification of the debt from the collector. If you get details that prove the debt is bogus, that should get them off your back immediately. State and Federal fair debt collection laws also prohibit harassing behavior by debt collectors, so if you don't want them calling you (that is, if they've started) then tell them as much.
