Legal Question in Credit and Debt Law in New York
collections-summons
I have tried to pay my debt with a payment plan and no one listens. They want all of it, now. My husband has received a summons and I called the lawyers in question. They will not discuss anything until they receive a copy of two recent paycheck stubs. These stubs have confidential info. I don't want to send the stubs , I would rather send a copy of my 2006 income tax. They said, ''no''.

Re: collections-summons
Providing a creditor's attorney with pay stubs gives the creditor the information it will need to garnish a judgment debtor's wages once a judgment is obtained.
The creditor is represented by an attorney and you are not. You are at a disadvantage and if you can afford it and the amount at issue warrants it should hire an attorney to represent you. You want to find an attorney that is experienced in dealing with credit card collection cases on the debtor side.
