Legal Question in Credit and Debt Law in New York

Continued Collection on 20 yr Old Judgment

I had a guaranteed student loan from the 1970's which I never paid due to job status, etc. in 1985 the NYS HESC got a judgment, but never collected because I had no assests.

Two years ago (2003) they sent a notice to my job that they were going to start administrative wage garnishment unless I agreed to a payment plan. I did agree to the plan and have been paying them monthly.

In January 2005, it will be 20 years since they obtained the judgment. My question is does that mean that there is no more judgment, and thus they have no recourse to continue collecting from me? If I stop making payments do they have legal recourse to use the administrative wage garnishmnet any more since the judgment will have expired?

thank you

Re: Continued Collection on 20 yr Old Judgment

Once you pay, the judgment is renewed.

Good Luck
