Legal Question in Credit and Debt Law in New York
cosigned car reposession
3 years ago I cosigned a loan with my then boyfriend to secure a car loan.
He has now defaulted and the car has been reposessed.
The car was purchased and he lives in NJ. I am now in NY.
I relize I am being held responsible for this debt.
Is the loan company going to be able to fully come after me and ignore his portion of this obligation since i can be held fully responsible? Is there anything I can do to now protect myself from having to pay this off in full?

They can come after you for FULL amount as you are jointly and individually liable for debt.
You can try and negotiate the balance but make sure if you do that you get a full release from them.

It appears that You are responsible for the full debt amount.
Consider filing for bankruptcy to get rid of the debt.

YOu are liable for the full debt, as a co-signer. While there are some options such as bankruptcy, such an option can seriously affect every other aspect of your current financial situation and should only be considered in extreme circumstances. I have negotiated cases EXACTLY like this where debts were as high as $20,000 and settled for about $3,000... such an agreement would not affect your credit rating and also, predominantly not affect other aspects of your financial life and future in any negative manner.
I would consider contacting an attorney experienced in these negotiations and attempting to settle, you can then subsequently sue the original borrower in court to atleats try and get a portion of the money back...
