Legal Question in Credit and Debt Law in New York
credit card collections SOL
I applied for a credit card on-line from Providian Visa. Three days later a person called my house stating he was from Providian and wanted some more info, he told me my S.S.# so I didn't think nothing of it. After I told him where I worked and the phone# he told me he was a collection agency. THe credit card bill was from 1991. Now he is harrassing my employer daily, what if anything can I do. Can a 10 year debt be enforced? Can my wages be garnished? Also did he break any laws when he said he work for Providian? Please help.

Re: credit card collections SOL
You actually have a cause of a civil action against them. What they did is against the law. You can sue them for tourtius unterference & for harrassment.
