Legal Question in Credit and Debt Law in New York

Credit Card Debt - IRS Involvement

I lost my job so my family is living off of my husband's salary only. I haven't been able to pay our credit card debts which is about $25,000. The cards are in my name with my husband as an authorized user. Can the credit card company's garnish my husband wages and/or seize the refund from our joint tax return?

Re: Credit Card Debt - IRS Involvement

The credit card company needs to sue you and get a judgment before they can do anything else.

When/if you get served, do not ignore the summons.

They can't garnish your husbands wage for YOUR debt nor sieze IRS refund.

However, they can freeze your joint bank account and make your husband work to prove the money was his. So....once there is a judgment against you, no direct deposits into joint bank account.

Have you considered bankruptcy?
