Legal Question in Credit and Debt Law in New York

credit card debt

My sister just passed away and left credit card debt of $15,000. All she had is life insurance from when she worked (she retired due to M.S disability). Can the credit card company claim their payment from the life insurance?

Re: credit card debt

Under New York law, Life Insurance passes directly to the beneficiary without the creditors of the insured having any claim on the funds.

This note is not legal advice and does not create an attorney-client relationship. Doing so would require the signing of an engagement letter.
