Credit Card Fraud

A New York based company I do work for received an order for a customer located in Singapore. The customer used a credit card to pay for the goods. Before shipping the goods, the company received authorization from the credit card processing company, to proceed. The goods were shipped and we subsequently found out the credit card information was stolen. The credit card company is now asking for the money back. What is our recourse?

You are in the right to keep the money.

However, prepare for litigation. The credit card company reasonably does not want to lose money. They have lawyers on retainer for this purpose.

If a settlement is offered, use your judgment, but do not pay more than 50%. The credit card company is unlikely to settle for less than 30%, and that may be a stretch. But you are in the right.
