Legal Question in Credit and Debt Law in New York

credit collections

My 84 year old mother is getting calls from collection agengies because, un beknownth to me, she apparently owes over 15000 on a credit card and a line of credit. Over the last few years she drew on these to live on. Her only income is from social security and her pension. She has no assets, no other funds. These payments to her are directly deposited into her bank in New York. Can a collection agency take these, her only income?

Re: credit collections

No, they are protected but it will be up to her to prove the source of funds if they ever get a judgment and freeze the accounts. Is anybody else on the account with her? She shouldn't leave a balance in the account as it would take time to undue a "freeze".

Tell her to tell them not to call her anymore or she will sue them for violation of FDCA.
