Legal Question in Credit and Debt Law in New York
Credit Ten Years after Bankruptcy Discharge
A chapter 13 Bankruptcy was discharged on my behalf in 1985 and I have since obtained credit from all of the prior creditors except American Express. Is the following a valid legal reason for Amex's denying my request in light of the Bankruptcy discharge?
...''our records indicate that your previous card account was canceled because payments were not made in accordance with our terms.''

Re: Credit Ten Years after Bankruptcy Discharge
Unfortunately AMEX has a right to continue their records and make decisions based on their content. They may not report the past transaction to other entities or make any attempt to enforce a past, discharged debt. But they are within their rights to not extend you further credit.
