Legal Question in Credit and Debt Law in New York
Debt Collection
Just trying to get some answers,I was contacted 2 months back about an outstanding balance(1200) on a credit card, I was sure that I had paid the amount off and explained this to Stewart and Associates who were the attorneys that contacted me. I no longer live at my parents residence, so it would take some time to find the paperwork stating the debt had been paid, if I still had the paperwork(this credit card is dating back seven years).About two days ago I received a letter in the mail stating I had 10 days to respond and resolve the matter or I would be sued. I contacted them and explained again the situation.I also told them that the first time I was contacted I tried to resolve the matter by paying it off monthly. I again told them I would do this but if the paperwork was found, would the payments stop too. They said they could not give me an answer on that. The two people that I talked with on the phone, were verbally abusive to me, I was trying to resolve the matter and they were not treating me like a human being. I did not feel comfortable giving them my routing number and account number after the way they talked with me on the phone. I would like to resolve the matter but would not like to deal with these people.

Re: Debt Collection
They are acting this way because, after 7 years, if they do not have a judgment or some statement from you that the debt is owed, then the debt will no longer be enforceable.
Pay nothing until you get 'the paperwork' and perhaps not even then. use your best judgment, but that is what is happening now.
