Legal Question in Credit and Debt Law in New York
Debt Collection
My husband and I bought a house,
then he lost his job which left us
unable to pay his credit card bills.
This was around January 2008. We
have gotten back on our feet and we
are looking to get this taken care of
in the best way possible. We sent a
request for validation to each (3) of
the collection agencies, asking for
validation of the debt, then we were
planning on attempting to come to a
resolution. The problem is the man
that keeps calling. He has called my
husbands' parents and told them
how much he owes, that he will be
sued on Monday, and asked them to
help him pay. I thought these tactics
were illegal and included in my letter
for validation a request to only
correspond through email. Today,
the same man called and I told him
we just sent a letter in response to a
letter they sent to us, and that the
letter should be arriving shortly. He
said that if I didn't put my husband
on the phone, he would send the
papers over and we will be
summoned immediately. I tried to
be calm in explaining the letter to
him, but he was outright harassing
me in a very loud tone, so I hung up.
What should I be doing now? Have I
done anything wrong?

Re: Debt Collection
You have done nothing wrong.
The collector has violated several provision of the "Fair Debt Collection Practices Act".
If you would like some help let me know. I can start off by sending them a cease & desist letter, there would be no charge to you for doing this.
Send me an email with your contact information.
