Legal Question in Credit and Debt Law in New York

debt collection purchase account

I'm being sued by a debt collection agency who purchaed my credit account. They said they purchased in 2006 and want interest from 2004. Didn't even know the credit card company had the rights to sell my personal information. I have no contract with this collection agency. I'm sure the debt agency didn't pay that much money to get account information. complaint never stated how much they payed for it. I don't understand how they can collect on this. What can I do about this?

They may be able to obtain interest for one year or more depending on when your last payment made on the account was or other facts. They most likely can sell the debt to another company but you can challenge the assignment (and the debt) and generally they would be required to provide proof of assignment (and debt) to win. You can defend yourself in court or you can try to settle the matter before it gets there but depending on the amount of the debt, your best option is most likely to find an attorney willing to negotiate and defend on your behalf.
