Legal Question in Credit and Debt Law in New York
I am in a debt consolidation program. I have $6000 in debt on 4 different cards, all same company. I would like to get out of the program, the only thing that concerns me are judgements. If I pay the companies $20 per month, even if it is sent to collections, can they get judgments against me as long as I continue to pay something regularly?

Making voluntary payments as you described will not preclude the creditor from bringing suit against you. There would have to be a payment agreement entered into with the creditor and you would have to pay according to the agreed upon schedule. Simply put, making voluntary payments of $20 outside of any agreement will not protect you from a judgment.
I have assisted people that were dissatisfied with there current debt settlement/consolidation program. We can discuss various options including bankruptcy or settling the accounts one by one. Call us for a free case evaluation.
