Legal Question in Credit and Debt Law in New York
Debt Judgement
I received a notice of default judgement against my husband, who is institutionalized due to dementia. Our only income source is SSI, Ss Disability, Veterans disability benefits. We have no other source of income. I know that these sources are exempt, however, the notice had this statement...$2500 of any bank account containing statutorily exempt payment electronically or direct deposited within the last 45 days (is exempt). What does this mean. Can they attach our exempt income up to $2500 that was deposited into our bank account? Should I withdraw all money from our bank account so I can pay our Mortgage and Buy Food?

Re: Debt Judgement
You are correct in your understanding of the law. SSI, SS disbility and vet disability benefits are exempt from execution. The creditor may not attach the exempt income. PERIOD.
