Legal Question in Credit and Debt Law in New York
Old Doctor Bill
We have been paying off a co-insurance bill balance at $50 a month against a $13,000 balance to an orthopedic surgeon since 2001. His office doesn't even send us statements anymore. We, therefore, stopped payment in January of this year (2009). Since we know the SOL is 6 years, should we expect litigation, or can we safely assume that any balance has been written off?

Re: Old Doctor Bill
Once you pay you toll the statute of limitations. Therefore, if you stopped payment in January 2009, the doctor has until January 2015 to commence an action.
Therefore, can you safely assume that any balance has been written off? No.
